Technical Limitations:  In order for UbiCare SmarteXp 3.0.1 modular EHR technology to be functional in a manner compliant the Meaningful Use Certification criteria, it must be configured to communicate with a complete EHR, which includes the patient problem list, medication list, lab tests and results. The communication must allow UbiCare SmarteXp to access and import the data from the problem list, medication list and lab tests and results.

Once the aforementioned communication with a complete EHR is established, the only other potential and limitation with regard to access to patient data and direct messages would be during brief periods of server maintenance or temporary, unscheduled outages.

Should a customer wish to establish a new connection with a third-party HISP, the customer must lodge a service request identifying the third-party HISP along with contact information for the HISP. UbiCare will establish, maintain and support technology to manage the connection. Third-party HISPs must agree to UbiCare’s connection and Business Associate Agreement. UbiCare will make every effort in good faith to establish such connectivity within a reasonable time frame (no longer than 3 months). However, we do not warrant that UbiCare will be able to establish agreements and required connections with all third-party HISPs.

Storage and archiving of patient data and direct messages on UbiCare's hosted, HIPAA-compliant servers is included with the annual licensing fee at no additional charge. Customers can access it at any time. The data generated is the customer’s to use as desired. The patient-specific education produced and delivered by the developer is the customer’s to use under the terms of the license agreement.
